Nondiscrimination, Harassment, and Intimidation

KCNS defines discrimination and harassment based on sex as

  1. Unlawful discrimination, including discriminatory harassment, intimidation, or bullying, may result from physical, verbal, nonverbal, or written conduct based on any of the categories listed above. Unlawful discrimination also includes the creation of a hostile environment through prohibited conduct that is so severe, persistent, or pervasive that it affects a student’s ability to participate in or benefit from an educational program or activity; creates an intimidating, threatening, hostile, or offensive educational environment; has the effect of substantially or unreasonably interfering with a student’s academic performance; or otherwise adversely affects a student’s educational opportunities. Unlawful discrimination also includes disparate treatment of students based on one of the categories above with respect to the provision of opportunities to participate in school programs or activities or the provision or receipt of educational benefits or services.
  2. Sexual harassment is defined in Education Code to mean unwelcome sexual advances; requests for sexual favors; or verbal, visual, or physical conduct of a sexual nature, made by someone from or in the educational setting. 

KCNS Nondiscrimination Statement:

King-Chavez Academy of Excellence, Inc. (“King-Chavez”) prohibits discrimination, intimidation, harassment (including sexual harassment)  or bullying based on a person’s age, actual or perceived ancestry, color, disability, race or ethnicity, gender, gender  expression, gender identity, immigration status, marital or parental status, medical condition, national origin, sex, sexual orientation, religion, or association with a person or group with one or more of these actual or perceived characteristics. This prohibition applies to all acts related to school activity or school attendance within all King-Chavez Academies.

Title X:

King-Chavez employees who are Title IX Coordinators, investigators, decision-makers, and any person who facilitates an informal resolution process undergoes relevant training. Modules include Title IX and Gender Equity" and "Title IX Compliance.” For further information, please contact your school's Title IX Coordinator.

 

Title IX is a federal law that was passed in 1972 to ensure that male and female students and employees in educational settings are treated equally and fairly. It protects against discrimination based on sex (including sexual harassment). In addition, Title IX protects transgender students and students who do not conform to gender stereotypes. State law also prohibits discrimination based on gender (sex), gender expression, gender identity, and sexual orientation. The preamble to Title IX of the Education Amendments of 1972 states that:

 

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”
